Wisconsin: Judge refuses to use injunction against equal marriage ban
A US federal judge says she won’t block Wisconsin’s equal marriage ban while a lawsuit challenging it moves forward.
The American Civil Liberties Union had asked District Judge Barbara Crabb to suspend the law via a preliminary injunction as part of their challenge to the ban.
Yesterday she declined their request warning that any injunction could quickly be overturned on procedural grounds.
But Judge Crabb signalled that she plans to move quickly to decide the case.
Instructing the ACLU to withdraw their injunction request, Judge Crabb said the plaintiffs should consider pursuing a “swift, final determination” in the US District Court in Madison “rather than litigating the case in multiple stages with no clear benefits to either side.”
In 2006, voters in Wisconsin approved a referendum banning same-sex marriage.
