US: Nebraska Supreme Court refuses to allow lesbian couple to divorce
A lesbian couple in the US state of Nebraska have been told by the state’s Supreme Court that the may not divorce.
The couple, Bonnie Nichols and her long-time partner Margie, married in 2009 in the state of Iowa.
Nichols filed for a divorce in 2013, but a judge in Lancaster County said the state could not grant a divorce, as that would me recognising the marriage.
The state of Iowa allows same-sex marriage, but the constitution in the state of Nebraska does not allow marriages between two people of the same sex, to be legally recognised.
Bonnie Nichols was given 15 days to file an amended complaint, but at the time said she would lose the ability to refile if she didn’t.
Following Nichols’ appeal, on Friday the Supreme Court said that because she appealed from a conditional order, and not a final judgement, the court lack jurisdiction.
