US: Court rejects another appeal from Pennsylvania clerk who won’t stop fighting equal marriage
A court has denied yet another attempt by a Pennsylvania clerk to appeal a ruling striking down the state’s same-sex marriage ban.
Same-sex marriage was legalised in Pennsylvania following a ruling by Judge John Jones on May 20.
However, despite the law already being in effect, Schuylkill County clerk Theresa Santai-Gaffney had sought permission to file an appeal, claiming that she had standing as the ruling had made the scope of her duties unclear.
She has repeatedly filed appeals against the ruling with multiple courts, taking her case as high as the US Supreme Court.
This week, the Third Circuit Court of Appeals rejected her latest attempt to demand an en banc review of the ruling.
An en banc review would mean all 15 judges in the court hearing her case, which has already been rejected in the same court by three judges.
She is expected to appeal the outcome once more, taking her case – represented by the Alliance Defending Freedom fund – back to the Supreme Court.
