ACLU files motion to have Kansas same-sex married couples recognised for benefits
The American Civil Liberties Union on Monday filed a request for a preliminary injunction, which would stop officials from denying benefits to same-sex married couples.
The ACLU said it was likely to succeed in the request, which would also stop the state from prohibiting same-sex weddings.
Last month the US Supreme Court stopped Kansas from enforcing its ban on same-sex marriage, pending a lawsuit in federal court.
Since then, some of the 105 counties in the state have been issuing marriage licences to same-sex couples, but not all.
The motion by the ACLU states that same-sex married couples are not recognised for spousal health insurance benefits, tax filing purposes and name changes for drivers licences.
Derek Schmidt, the Attorney General of Kansas has said he plans to continue to defend the state’s ban on same-sex marriage.
