Kim Davis faces another lawsuit over gay marriage licences
Kim Davis faces another lawsuit which could again land her in jail, over her refusal to directly issue marriage licences to same-sex couples.
The Rowan County Clerk spent five days in jail for contempt of court earlier this month for refusing to issue marriage licences to gay couples.
On Monday, lawyers acting for two gay couples and two straight couples filed a lawsuit questioning the validity of marriage licences issued while Davis was in jail.
The licences did not include Davis’ name, and were issued by her deputies.
Judge David Bunning ruled that the licences were valid.
But the lawsuit filed on Monday asked Rowan County to reissue the licences.
If Davis refuses, lawyers asked the judge to put the office in receivership, which would mean someone else would have to do it.
Speaking to Good Morning America on Monday, Davis said she was prepared to return to jail over the issue.
She claimed she is not homophobic – but doesn’t think gay people deserve to be treated with dignity.
Despite claiming she is just a persecuted Christian, Davis is represented by extremist lawyer Mat Staver – who is affiliated with a number of listed anti-LGBT hate groups.
Staver was condemned by the Jewish Anti-Defamation League earlier this month for comparing his client to Jews in the gas chamber.
