Gay man jailed for oral sex with drunk, unconscious straight victim
A gay man was jailed this week for giving oral sex to his unconscious victim.
Dale Everard, 22, was found guilty of sexual assault while the victim was asleep, under the influence of alcohol and incapable of giving or withholding consent.
The incident took place in May 2014, when Everard befriended the man and his girlfriend in a bar, after a blind date he was on did not go as planned.
Everard spent most of the evening laughing and dancing with the man’s girlfriend, so the victim left the pair to enjoy themselves as he “felt drunk and had a headache”.
His girlfriend left a few hours afterwards with Everard, who she preceded to invite back to the flat she shared with her boyfriend in Dunfermline, Scotland.
Upon their arrival, the victim argued with his girlfriend, as he was unhappy with having a stranger in the flat.
He then fell asleep on top of the pair’s bed fully clothed – with his girlfriend falling asleep on the sofa.
The victim awoke a few hours later to find someone giving him oral sex. He initially assumed it was his girlfriend, so says he kept his eyes closed.
However, he was shocked to discover that it was actually Everard.
“You liked it”, Everard told the victim, before being pushed out onto the street.
He later sent a Facebook message to the girlfriend, telling her: “Your boyfriend needs to calm down.”
Everard – a first time offender – was sentenced to 18 months in prison earlier this week. He has also been placed on the sex offenders register.
“This was a serious offence carried out with considerable forethought. You befriended the victim’s girlfriend, went back to the flat with her, entered the bedroom and carried out the sexual assault,” said Sherrif Craig McSherry.
Defence solicitor Stephen Morrison said his client was “ashamed and appalled” by his actions, which he says happened when he was heavily intoxicated.
