Kim Davis files case asking people to stop suing her

Kentucky county clerk Kim Davis has launched a legal case to stop her from being personally sued for refusing to issue same-sex marriage licenses while in office.
Davis, who was put in prison for five days for refusing to issue the licenses, is attempting to field all legal cases against her, with the defence that they should be filed against the state.
Represented by The Liberty Counsel, which is an Evangelical Christian advocacy group, Davis has filed briefs in the 6th U.S. Circuit Court of Appeals asking for the dismissal of two complaints that were filed against her because of what she did on behalf of the county and state.

“Davis is entitled to qualified immunity from plaintiffs’ claims because plaintiffs have not established a violation of their constitutional right to marry, let alone any clearly established constitutional right,” reads the document.
Plaintiffs failed to identify any federal constitutional right, under Obergefell v. Hodges or otherwise, to receive a marriage license from a particular state official (Davis) at a particular place (Rowan County), irrespective of Davis’ protected religious liberty rights, when no state policy was preventing either plaintiff from marrying whom he wanted to marry, or obtaining a valid Kentucky marriage license.”
The Liberty Counsel recently published a biography of Davis entitled “On God’s Authority”.
The Counsel said the book “goes behind the scenes to reveal how God gave this unlikely candidate a platform to defend marriage and religious freedom”.
“For the first time, Kentucky county clerk Kim Davis goes public with the inside story behind her courageous stand for marriage and religious freedom—and her six days in jail,” reads the blurb.
“Kim takes you behind-the-scenes of the unlikely saga that took America by storm in 2015.
“She tells how God transformed her life in 2011, why she almost retired in 2014, and how she knew—six months before the U.S. Supreme Court’s disastrous 2015 same-sex ‘marriage’ opinion—she was headed for jail.
“Kim chronicles her dramatic encounters with furious, fist-pounding, homosexual men and the hate mail that flooded her office.
Davis has announced that she would not re-run for her position as county clerk this year.
As a clerk, Davis receives an annual salary of $80,000.

In March, Kentucky governor Matt Bevin claimed that Ms Davis was an “inspiration” to children across America.
The Republican lavished praise on Ms Davis as he helped her promote her upcoming memoir.
He claimed that Davis would be remembered for “her boldness and conviction” in “knowing that she was right.”
According to Right Wing Watch, Bevin claimed: “Against all the scorn, all the enmity, all the vitriol, all the nastiness, she stood firm.
“I think Kim Davis is without question an inspiration, not only to leaders like myself – people in the public arena and those outside the public arena – but to my children, the children of America.
“People, even if they disagree with her, have go to respect the fact that here is a woman who was willing to put it all on the line out of conviction for what she believed and knew to be her right as an America citizen.
“Her faith and her conviction in the fact that that faith was protected by the First Amendment in our Constitution – in our Bill of Rights, specifically – is something that she was willing to put front and center, and if that’s not admirable, if that’s not something we would want all Americans to emulate, I don’t know what is.”
More recently, but equally as bizarre, Ms Davis’ lawyers called for a ban on Girl Scout cookies.
They asked members of the public not to purchase Girl Scout treats as they “promote abortion and promiscuous sex”.
The Liberty Counsel founder and chairman Mat Staver said: The once great Girl Scouts USA took a tragic fall when it became a political advocacy group that promotes abortion and sexual promiscuity to innocent girls.

“It’s important that people understand that it profits from cookie sales go toward harming young girls rather that helping them.
“I encourage people to say, ‘no, thank you’ to Girls Scouts and support alternatives that encourage Christian values such as American Heritage Girls.
“This organization has partnered with Trail Life USA, a rapidly expanding alternative to the Boy Scouts,” he added.
Girl Scouts USA, which is part of the World Association of Girl Guides and Girl Scouts, asks as a cohort to empower women and their sexuality, right through from abstinence to abortion support.
As the World Association of Girl Guides and Girl Scouts (WAGGGS) “demand access to comprehensive sexuality information, services and supplies for all young people,” this is enough of an offence for lawyers at the Liberty Counsel to rally against the selling of the goods.
The time-honoured tradition of Girl Scouts selling cookies is a way for women to raise funds for their organisation.
The Scouts are known to sell the cookies during intervals at The Academy Awards.
